Publix Gasparilla Distance Classic Parrot Naming Contest 2021
The Publix Gasparilla Distance Classic Parrot Naming Contest (“the Contest”) will run from October 1, 2021 at 8:00 AM ET and end October 31, 2021 at 11:59 PM ET. Entry into the contest constitutes the entrant’s full and unconditional agreement to and acceptance of these rules, terms and conditions. In addition, entrant agrees to accept the decisions of the Sponsor, Promotion Parties, and Judges as final and binding in all matters related to this Contest.
HOW TO ENTER
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. Only one (1) entry per person per day is permitted. Entries must not contain any racial, religious or ethnic slurs, explicit language, obscene, pornographic, violent, or sexual content, libel, hate speech, reference to alcohol, drugs or other illicit substances or otherwise unlawful, inappropriate, objectionable, offensive or illicit content, as determined by Sponsor. All entries must be received by October 31, 2021 at 11:59 PM ET. Times Publishing Company (“Sponsor”) is not responsible for lost, late, damaged, illegible, misdirected, or incomplete entries; or for errors in mechanical transmission, or other technical difficulties. Entries become the property of Times Publishing Company and will not be returned. Each Entrant acknowledges and agrees that Sponsor may use information submitted to contact Entrant and/or to offer Sponsor’s products or services.
Contest is open only to U.S. citizens who are legal residents of the state of Florida and who are at least 18 years of age as of October 1, 2021. Employees of Gasparilla Distance Classic Association, Publix Super Markets, Inc. , and Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members (collectively the “Promotion Parties”) are not eligible to win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company and the Promotion Parties’ determination as to eligibility is final and binding.
To claim prize, Grand Prize winner must appear in person by appointment at a Times Publishing Company office during regular business hours and present valid, government-issued photo identification showing age and residency. Winner will be required to sign legal documents or provide additional proof of eligibility. Winner may also mail an original signed affidavit , w-9, and copy of a valid government-issued photo identification to Times Publishing Company, Attn: parrot Naming contest, 490 First Ave. South, St. Petersburg, FL 33701. For security purposes, this information should be mailed USPS certified mail or by Express Courier of choice that included receipt proof of delivery. Specifically, Winner must complete a notarized affidavit of eligibility, which releases Sponsor, its affiliates, and prize suppliers from any and all liability related to this Contest or use or acceptance of the prize. Winner must complete the affidavit of eligibility, without making changes, and return the properly completed affidavit for receipt by Times Publishing Company within 10 days of the date the winner received prize notification. Failure of Times Publishing Company to receive a properly executed affidavit within 10 days of winner notification will result in disqualification and forfeiture of prize. Alternate winner is subject to all requirements and limitations in these Official Rules. By accepting a prize, the winner agrees to allow the use of his or her name, voice, photograph, likeness and any information provided on the entry form, (in any media now known or hereafter invented) and for any purpose, including advertising, promotional or other purposes, by Times Publishing Company and its affiliates, without further compensation.
NOTIFICATION OF WINNER
Winner(s) will be judged and selected by a panel of six (6) judges . The judging panel is comprised of three (3) representatives from the Gasparilla Distance Classic Association and three (3) representatives from Publix Super Markets, Inc. or agency. The judging will be held on or around December 1, 2021. A Times Publishing Company representative will notify winner(s) by email using the information on the entry form. Odds of winning depend on the number of eligible entries received. The Winner(s) must produce adequate proof of identity, such as a driver license or photo I.D. card, in order to take possession of the Prize.
The following prize will be awarded to the Winners: There will be one (1) Grand Prize winner whose Parrot Name entry will be given to the Publix Gasparilla Distance Classic Parrot. The Grand Prize winner will receive a $100 Publix Gift Card and one (1) Complimentary Entry to the Publix Gasparilla Distance Classic for twenty-five (25) years (value $3,000). There will be a 2nd and 3rd place Winner selected from the entries by the panel of judges. Both the 2nd and 3rd place winners will each receive a $100 Publix Gift Card. Grand total for prizes is $3,300. The Winners will be listed in an edition of the Tampa Bay Times and/or online. No substitution, transfer or deferral of the annual complimentary Publix Gasparilla Distance Classic entry will be allowed, except at the sole discretion of Sponsor. All decisions of Sponsor regarding the Contest are final.
The prizes furnished by Gasparilla Distance Classic Association, Publix Super Markets, Inc., and Times Publishing Company, are valued at $3,300. No alternative prize or other substitution is permitted except in the event of prize unavailability, in which case Sponsor reserves the right to substitute a prize or prizes of equal or greater value. Prizes are not transferable or assignable by the Winner. Winner is responsible for any charges not specifically listed as part of the prize or to redeem or make use of prize, including transportation to and from any destination in connection with taking possession of or using the Prize, and any and all taxes, if any. All federal, state and local taxes, fees, and surcharges, and any necessary or appropriate insurance, are the responsibility of the winner. Winner agrees to pay all such taxes, fees, and surcharges and is responsible for furnishing proof of insurance if and as required by law. The winner must complete a W-9 tax form provided by Times Publishing Company prior to taking possession of the Prize. Winner must agree to hold the Sponsor and Promotion Parties harmless from any and all liability for damages or losses of any nature incurred in connection with use of the prize, including transit to and from any destination in connection with the prize.
Contest rules shall be governed and enforced pursuant to Florida law, excluding choice of law provisions. All other federal, state, and local laws and regulations apply. Void where prohibited by law. Entrants agree to be bound by these rules. Sponsor is entitled to interpret these rules as needed and their decisions are final. Sponsor reserves the right to correct typographical, clerical or printing errors in any Contest materials. Any person attempting to defraud or in any way tamper with the secure operation of this Contest will be disqualified and ineligible to win. Sponsor reserves the right to terminate or cancel this Contest at any time in such circumstances. In such circumstances, the Prize will be awarded based on entries received as of the date of termination.

ADDITIONAL TERMS AND CONDITIONS
By entering the Contest, the entrant, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Sponsor and Promotion Parties arising directly or indirectly out of entrant’s participation in the Contest. For purposes of this waiver and release, “Sponsor” includes Times Publishing Company and its parents, subsidiaries, affiliates, officers, directors, agents and employees. For purposes of this waiver and release, “Promotion Parties” includes Gasparilla Distance Classic Association and Publix Super Markets, Inc. and its parents, subsidiaries, affiliates, officers, directors, agents and employees. This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not. Sponsor reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. Sponsor is not responsible for typographical or other errors in printing, the offering, or the administration of the contest or in the announcement of the prize.
The Publix Gasparilla Distance Classic Parrot Naming Contest OVERVIEW
The Publix Gasparilla Distance Classic Race (PGDC) Weekend Events, held annually in Tampa, FL since 1978, has adopted a colorful, beautiful, witty, smart, funny, kind and cute Parrot as its mascot. The PGDC Parrot, currently without a name, will come to life during the 2022 PGDC Race Weekend. The PGDC Parrot needs a name that matches its personality! Three PGDC Parrot Names will be selected. The person submitting the name chosen will win a Publix Gasparilla Distance Classic complimentary entry for 25 years, valued at $3,000 and, a Publix $100 Gift Card. The 2nd and 3rd Place winners will each receive a Publix $100 Gift Card.
JUDGING CRITERIA AND CONTEST RULES
1. To fill out an Entry (the “Ballot” or “Ballots”) and participate in this Contest, the Entrant should visit (the “Website”) during the Contest Period, complete the form with the required contact information, and submit the Entry Form.
2. Ballots will be accepted during the Contest Period. Ballots must be received by October 31, 2021 at 11:59 p.m. ET in order to be eligible (the “Ballot Deadline”). No Ballots will be accepted after this time.
3. Ballots will not be accepted through e-mail, text, facsimile, U.S. Postal Service or other express delivery services. Ballots submitted with multiple e-mail addresses, under multiple identities or through the use of any agent or other device to enter multiple times will be deemed invalid. The use of any automated system to submit Ballots is prohibited and will result in disqualification of all such Ballots as well as the Entrant.
4. Eligible entries will be judged by a panel of judges on or about December 1, 2021. Judging will be based on creativity, humor, theme, and catchiness. Entries must not have been a previously published name and must be entrant’s original work. In the event of a tie, tied entries will be re-judged by the panel and Sponsor may assist to break the tie. There is no fee to submit an entry in this Contest.
5. SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO DISQUALIFY ANY BALLOT OR VOTE AT ANY TIME THAT IN ITS OPINION DOES NOT COMPLY WITH THESE RULES. If Sponsor determines, in its sole discretion, that the security, administration, fairness and/or operation of the Contest has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond Sponsor’s control, Sponsor may terminate the Contest. If Sponsor terminates the Contest, Sponsor will post notice of same on the Website and provide eligible, non-suspect entries received as of the termination date to the judges for review and selection.
